General Terms and Conditions
1. Scope
(1) These General Terms and Conditions (hereinafter “GTC”) apply to all contracts concluded between
Oberheim Speakers GmbH,
Brunnenstraße 10,
(hereinafter “Seller”)
and consumers or entrepreneurs (hereinafter “Customer”)
via the online shop https://oberheim-speakers.de/shop.
(2) Deviating terms and conditions of the Customer shall not be recognized unless the Seller expressly agrees to their validity.
2. Conclusion of the contract
(1) The products displayed in the online shop do not constitute a legally binding offer, but rather a non-binding invitation to place an order.
(2) By clicking the “Buy now” / “Order subject to payment” button, the customer submits a binding offer to conclude a purchase agreement.
(3) The contract is concluded as soon as the seller accepts the order by sending an order confirmation via e-mail or dispatches the goods.
3. Prices and shipping costs
(1) All prices quoted include statutory VAT and exclude any applicable shipping costs.
(2) The shipping costs will be clearly communicated to the customer during the ordering process.
4. Payment
(1) The available payment methods are displayed to the customer during the ordering process.
(2) The purchase price is due immediately upon conclusion of the contract.
(3) If a payment service provider is selected, payment processing will be handled by the respective provider. Their terms and conditions apply.
5. Delivery and delivery conditions
(1) Delivery is made to the delivery address specified by the Customer.
(2) Delivery times are stated in the online shop. If no delivery time is stated, delivery will be made within [e.g. 3–5 business days].
(3) If a product is not available, the Customer will be informed without undue delay.
6. Retention of title
The goods remain the property of the seller until the purchase price has been paid in full.
7. Right of withdrawal
(1) Consumers have a statutory right of withdrawal.
(2) The details of the right of withdrawal result from the separate withdrawal instructions, which are made available to the Customer during the ordering process.
8. Warranty
(1) The statutory warranty rights apply.
(2) For business customers, the warranty period shall be 12 months from delivery of the goods, insofar as legally permissible.
9. Liability
(1) The seller shall be liable without limitation in cases of intent and gross negligence.
(2) In cases of slight negligence, the seller shall only be liable for breaches of essential contractual obligations and only to the extent of foreseeable damages.
(3) Liability for damages resulting from injury to life, body or health remains unaffected.
10. Digital Content
If digital content is offered, the seller ensures that it complies with legal requirements. Further details can be found in the respective product description.
11. Contract language and contract text storage
(1) The language of the contract is German.
(2) The contract text will be stored by the seller and sent to the customer by e-mail after conclusion of the contract.
12. Data protection

13. Final Provisions
(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the Seller’s registered office.
(3) If individual provisions of these GTC are invalid, the validity of the remaining provisions shall remain unaffected.
